The Association represents hospitals before the Louisiana Supreme Court, state courts and in federal district courts as authorized by the Board of Trustees or the LHA President/CEO. Briefs have been filed on peer review, Department of Insurance regulatory matters, malpractice and other tort issues. This department also assists members through consultation on legal issues ranging from public hospital laws, patient care, Stark II, OIG guidance, to hospital/physician relations. This includes assisting members in analyzing legal questions, researching specific issues and preparing them to work with their own legal counsel to resolve complicated issues. This department also provides legal support to the LHA and its affiliated organizations.
The legal department oversees Impact Lawbrief, a monthly newsletter that analyzes legal developments and trends of interest to the hospital community written by members of the Louisiana Society of Hospital Attorneys. The Society sponsors the annual Health Law Symposium, offering 100% of the required continuing legal education (CLE) opportunities to healthcare attorneys on the latest legal issues with the most up-to-date information.
